General Terms and Conditions.

Below you can read the general terms and conditions of LINUM AB, a home textile company and design brand, for purchases made via www.linumdesign.com, where LINUM AB is the party with whom you as a Customer have entered into or wish to enter into a purchase agreement. If a purchase of a LINUM product has been made through a reseller, it is the reseller with whom you as a Customer have your purchase agreement, not LINUM AB. The reseller should therefore be contacted directly.

1. Definitions of parties
The following terms (the “Agreement” below) are designed for e-commerce via www.linumdesign.com. LINUM AB (company registration number: 559342-0481) constitutes the selling party. You (the “Customer” below) constitute the purchasing party.

For further clarification, the publication date of the Agreement is stated in the heading. If the Agreement has been changed, an end date will be specified. If an end date is specified, the Agreement will apply until 23:59 on the day the Agreement expires. You as a Customer will have the opportunity to accept the terms when placing your order.

Terms or parts of this Agreement that deviate from applicable legislation have no effect unless the deviation benefits the Customer. This provision applies only if the Customer is a private individual and the purchase is intended solely for personal consumption.

The terms of this Agreement are intended for private individuals over 18 years of age and for the sale of goods (the “Products” below) and associated shipping services.

2. Purchase

2.1 Completion of purchase.
LINUM AB receives the Customer’s order when the Customer clicks the “pay” button at checkout, and once the payment has been approved, the Customer will receive an order confirmation via the email address provided at the time of purchase. When the purchase has been approved and LINUM AB has sent the order confirmation, the Agreement enters into force.

To shop on linumdesign.com, the Customer must be at least 18 years old or have received written consent from a parent or legal guardian.

LINUM AB reserves the right to cancel orders that lack correct and/or adequate customer information.

2.2 Purchase process.

Order confirmation.
When the Customer has placed an order, an order confirmation will be sent to the specified email address with information about the purchase. The order confirmation also serves as the Customer’s receipt and legal proof of purchase. Depending on the email client and security settings of the receiving device, the order confirmation may end up in the spam folder. LINUM AB therefore recommends checking this before making contact.

When LINUM AB has sent the order confirmation, the Agreement is concluded. If LINUM AB is unable to deliver the order, we will contact the Customer within 48 hours (excluding public holidays). If possible, we will offer the Customer an alternative solution and, if accepted, a new Agreement will be entered into.

Shipping confirmation and tracking information.
When the Customer’s order has been packed and shipped from the warehouse, the Customer will receive a shipping confirmation via the email address provided at purchase. An additional email will be sent from the transport management system Unifaun with tracking information when the package is ready to leave the warehouse. Depending on the email client and security settings of the receiving device, the order confirmation may end up in the spam folder. LINUM AB therefore recommends checking this before making contact.

2.3 Cancellation or modification of a purchase.
If the Customer has any questions regarding the purchase, they are asked to contact LINUM AB as soon as possible. Use or include the same email address used for the order as well as the order number found in the order confirmation. Contact LINUM AB at customerservice@linumdesign.com

To cancel an ongoing purchase, the Customer must notify LINUM AB before the order has been packed by our warehouse partner. Once the order has been packed, it cannot be cancelled but will be shipped as intended, and the Customer must return it according to the standard procedure (within 14 days). LINUM AB unfortunately does not have the ability to modify, add, or remove products from placed orders. If the Customer wishes to do so, LINUM AB recommends cancelling the order or returning it once received and then placing a new order.

3. Prices, VAT and customs

3.1 VAT and customs.

European Union (EU):
For purchases within the EU, prices include the VAT applicable in each respective country. Orders are shipped on a DDP (Delivery Duty Paid) basis, meaning all taxes and customs duties are included in the total price at checkout.

Norway:
For purchases to Norway, prices include Norwegian VAT of 25%.

LINUM AB is registered under the VOEC (VAT On E-commerce) scheme, meaning Norwegian private individuals do not need to pay customs duties when purchasing from a Swedish business up to a value of 3000 NOK per item. Orders are shipped on a DDP (Delivery Duty Paid) basis, meaning all taxes and customs duties are included in the total price at checkout.

United Kingdom:
For purchases to the United Kingdom, prices include VAT of 20% as well as customs duties/fees. Orders are shipped on a DDP (Delivery Duty Paid) basis, meaning all taxes and customs duties are included in the total price at checkout.

Other countries outside the EU:
The order is shipped on a DDU (Delivery Duty Unpaid) basis, meaning the total price shown at checkout excludes local taxes and duties.

For international orders, taxes and duties determined by the customs authority in the destination country may apply. Although this does not always occur, the assessment of duties and taxes will be based on the order value and any threshold for tax-free purchases applicable in the destination country. Payment of duties and taxes is therefore the responsibility of the recipient. Sometimes this may be indicated as an additional postal fee. LINUM AB unfortunately has no control over or influence on such charges, and it is the responsibility of each customer outside the EU to familiarize themselves with the regulations of their specific country. More information can be obtained from your local customs office.

3.2 Offers and campaigns.
Special offers and campaigns advertised on linumdesign.com are valid for as long as the campaign runs and stock lasts. LINUM AB reserves the right to end campaigns early and/or change their content. LINUM typically communicates approximately 48 hours before a campaign or sale ends via its active communication channels, and it is not possible to purchase an item at a discounted price after the campaign/sale has ended and prices have returned to their regular levels.

If an item has been discounted, current regulations regarding the display of the item’s price adjustment over the past 30 days apply. For a price-reduced item, the symbol “i” is shown and an information box becomes clickable, clearly displaying the item’s price changes over the past 30 days.

3.3 Reservations.
We reserve the right to make price changes, and to correct technical errors or other communication mistakes, and we reserve the right to adjust our prices without prior notice.

4. Products and assortment

4.1 Certificates and standards.
Swedish and international environmental and safety regulations constitute the standard for how LINUM AB’s products are manufactured. LINUM AB’s manufacturers currently use the following certifications and standards:

4.2 Colours and product assortment.
We do our best to display our products as accurately as possible. Since colour perception may vary depending on the screen on which it is viewed, we cannot guarantee that the colours shown on the buyer’s screen correspond to the actual product. Furthermore, LINUM AB cannot guarantee that the information in our webshop is error-free; therefore, we welcome questions or feedback regarding colour shades and any other matters at customerservice@linumdesign.com

Please note that the product shade may vary slightly between deliveries. We do our utmost to follow our colour codes and make the products as similar as possible, but deviations may occur. LINUM AB manufactures all its products in 100% natural materials, with the exception of products containing some type of filling/padding.

4.3 Stock status.

If a product is marked “Coming soon”, it has been reordered and will be back in stock within a few weeks. LINUM AB reserves the right for this marking to change at short notice as a result of stock updates.

If a product is marked “Sold out”, the product has not yet been reordered and no new launch date is available. LINUM AB reserves the right for this marking to change at short notice as a result of stock updates. Products that are sold out and will not return to the assortment are removed entirely from linumdesign.com. However, old links may remain even though they have been deactivated by LINUM AB, and in rare cases sold-out items may therefore still be shown even though they have been removed from linumdesign.com.

If an item has a very low stock balance at the time of sale, there is always a risk that the balance is incorrect. In such cases, LINUM AB will contact the Customer immediately to find a solution.

5. Payment

5.1 Provider of payment solutions and payment methods.
LINUM AB uses Kustom Checkout to ensure a smooth and secure payment experience at checkout. Payments are handled by certified payment providers and comply with applicable security standards, including PCI DSS and 3D Secure for card payments.

Available payment methods are always shown at checkout and may vary depending on country, device and customer choice.

Once the Customer has completed their payment, the Customer receives an immediate confirmation at checkout and the order is registered automatically. The Customer will also receive an order confirmation by email. We ask the Customer to wait for the confirmation before leaving the page. Once the purchase has been approved, confirmation is shown at www.linumdesign.com.

5.2 Card payments.
Card payments may be offered via, for example, Visa, Mastercard and American Express. Card details are handled securely and encrypted via the payment solutions available in Kustom Checkout. Which cards and payment options are offered may vary depending on the market and the Customer’s choice at checkout.

5.3 Digital wallets and alternative payment methods.
LINUM AB may offer various digital and alternative payment methods via Kustom Checkout, such as Apple Pay, Google Pay, Swish and other local payment methods depending on the market. Current options are always shown at checkout before the purchase is completed.

5.4 Local payment methods.
Depending on the market, local payment methods may also be offered, such as Vipps, MobilePay, iDEAL, Bancontact, TWINT, BLIK and Cartes Bancaires. Which methods are available is always shown at checkout.

5.5 Klarna.
When paying via Klarna, Klarna’s terms apply to, for example, invoice payment, instalment payment, direct payment and returns. As a Klarna customer, you are responsible for complying with Klarna’s payment terms.

Please note that LINUM AB does not handle customer service matters with Klarna. If the Customer has questions regarding payment, invoice, instalment payment or refund via Klarna, the Customer must contact Klarna directly.

5.6 Other payment options.
Depending on the market and customer type, other payment options may also be available, such as direct bank payment (Pay by Bank), bank transfer or Billie for B2B invoicing. Available payment methods are always shown at checkout.

In order to offer different payment options, LINUM AB needs to share the Customer’s personal, contact and order information with the relevant payment service provider to the extent necessary to complete the purchase. We recommend that every Customer reads our data handling policy. The use of this information is governed in accordance with applicable data protection legislation and the terms of the relevant payment service provider.

6. Shipping and delivery

6.1 Shipping process.
All orders are handled by LINUM AB’s third-party distribution centre in Gothenburg within two business days, subject to payment approval and stock availability. The warehouse processes incoming orders on weekdays from Monday to Friday.

When the Customer’s order has been packed and shipped from the warehouse, the Customer will receive a shipping confirmation at the specified email address. An additional email will be sent from the transport management system Unifaun with tracking information for your package when the package is ready to leave the warehouse. Please make sure to provide the correct email address in connection with your purchase and check your email client’s spam filter if the order confirmation has not been received.

When the Customer’s package is ready for collection, the Customer will receive a notification via SMS or via the carrier’s own app where applicable. The package will be delivered either to a parcel shop or parcel locker near the address provided by the Customer when ordering the products, or to the Customer’s door, depending on destination and chosen shipping option.

Please note that, using the tracking link received by email from Unifaun, you as the Customer can often track and change information relating to your delivery directly with the carrier. LINUM AB is not responsible for changes in the delivery chain that the Customer has booked and arranged directly with the transport company.

6.2 Shipping costs.
Shipping prices within the EU, Norway and the United Kingdom are inclusive of VAT.
Sweden: 49 SEK (Budbee Box) | 99 SEK (Budbee Home and Postnord).
Norway: 199 NOK (UPS).
Denmark: 79 DKK (UPS).
Germany: 9 EUR (DHL).
France: 9 EUR (DHL).
Italy: 9 EUR (DHL).
United Kingdom: 20 GBP (UPS).
Other EU countries (Austria, Belgium, Czech Republic, Finland, Greece, Hungary, Ireland, Poland, Portugal, Romania, Slovakia, Spain) and Switzerland: 10 EUR (UPS).
Other countries outside the EU: 20 EUR / 250 SEK / 250 NOK / 200 DKK / 20 GBP (UPS). Local taxes and duties may apply.

If you have selected a different currency, the shipping cost will be displayed in your chosen currency at checkout.

6.3 Delivery time and carriers.
LINUM AB uses Budbee, Postnord, DHL and UPS. Within Sweden, delivery takes place within 1–3 business days. For other countries, delivery takes place within 2–5 business days. Delivery times are calculated from the time the Customer has received the order confirmation. If the Customer chooses on their own initiative to update their delivery preferences, LINUM AB’s stated delivery time no longer applies.

6.4 Risk of loss.
During transport, LINUM AB is responsible for the order until it has reached the Customer. Once the order has been delivered by the carrier or collected, responsibility is transferred to you as the Customer.

6.5 Uncollected parcels.
If the carrier is unable to deliver the Customer’s package, it will be returned to LINUM AB’s warehouse. LINUM AB registers IP addresses at the time of purchase. If we receive a returned package from a customer/recipient who has refused the package, we reserve the right to charge the customer for all resulting costs and add a handling fee of 200 SEK/200 NOK/200 DKK/20 EUR. The fee is automatically deducted from the amount paid for the order. If the handling cost exceeds the Customer’s order value, no money will be refunded to the Customer. If the Customer has more than two uncollected parcels within a one-year period, the Customer will be blocked from shopping at www.linumdesign.com.

7. Returns and refunds

7.1 Introduction.
LINUM AB has a large share of international customers and therefore offers a 14-day open purchase period on all products regardless of price at www.linumdesign.com. All products can be returned without exception. As the return handling process passes through several steps, it usually takes up to 14 days to process from the time the package leaves the Customer’s post office.

7.2 Exchange of product.
We do not have the possibility to exchange one product for another. However, the Customer may always return the product(s) and then place a new order. The return shipping cost is charged at the same amount as the original shipping fee. The original shipping cost is not refunded upon return.

7.3 Refund.
Refunds are made within 14 days from the date we receive the Customer’s return, via the same payment method chosen by the Customer at the time of purchase. LINUM AB administers all return refunds, so if you as a Customer have a question regarding your refund, please contact us at customerservice@linumdesign.com.

8. Right of withdrawal
A Customer who enters into the Agreement as a private individual has the right to withdraw from the Agreement without giving any reason under the Swedish Distance Contracts and Off-Premises Contracts Act (2005:59). The right of cancellation does not apply to Customers entering into the Agreement in the capacity of a business. All items in the order must have been delivered for the withdrawal period to begin. If delivery takes place on different occasions, the period begins when the last part of the order has been delivered. If you as a Customer return fewer products than were included in the total order, you will only be refunded for the products you have returned.

You as a Customer must, when exercising the right of withdrawal under distance selling legislation, notify LINUM AB within 14 days from the date you have taken possession of the product or products. You do this by following the instructions under shipping, delivery and returns. Read more in General Terms and Conditions – 7. Returns and Refunds. For the right of withdrawal to be valid, the order must be returned in new and unused condition. This means that each Customer does not have the right to use the product more than necessary to inspect it. According to law, when cancelling one or more items, you as a Customer are obliged to return all products to LINUM AB and pay for the return shipping. LINUM AB always has the right to grant more generous terms than those prescribed by law.

Certain products are exempt from the right of withdrawal under the Swedish Distance Contracts and Off-Premises Contracts Act (2005:59), for example products that have been manufactured, altered or adjusted at the request of the customer or have otherwise been given a special characteristic or are subject to a separate agreement.

9. Complaints and warranties

9.1 Instructions for complaints.
If you believe that an item is not of satisfactory quality, the Customer should notify LINUM AB as soon as the item has been received by email to: customerservice@linumdesign.com.

Please include the following in your email:

  1. A short description of what is wrong with the product and one or more pictures clearly showing the problem.
  2. Take a picture of the paper label attached to the product so that LINUM AB can trace where the defect may have arisen.
  3. State the order number, the date the purchase was made and the email address used when you as a Customer placed your order.

LINUM AB tries to prioritise each Customer’s case, but please note that an assessment of the material may take up to seven business days as LINUM AB may need to contact the relevant manufacturer. If LINUM AB considers the product to be defective, the Customer will either receive a full refund for the complained-about item including shipping costs, or a new item will be sent. Further information regarding LINUM AB’s complaints policy can be found here.

NOTE: Do not send the item you wish to complain about to LINUM AB without first having been in contact with LINUM customer service to have your complaint approved. If you do so, it may unfortunately mean that we cannot process your complaint or refund the shipping costs.

9.2 Terms for complaints.
A Customer who has purchased a Product as a private individual has the right to submit a complaint and return the Product if it is defective under the Swedish Consumer Sales Act (1990:932) and the Swedish Consumer Services Act (1985:716). The law covers all original defects that arise within 3 years of receipt of the product. The warranty also covers defects that have arisen during shipping and transport (see below: 9.3 Complaints due to transport damage).

The defect must be reported as soon as possible after it has been discovered. Reporting a defect within 2 years of receiving the Product is always considered to be within a reasonable time. The Customer must provide a description of what is perceived to be defective so that LINUM AB can assess the information. The Customer must also contact LINUM AB if there may be a delay in providing the information.

Please note that you as a Customer must be able to present valid proof of purchase for the item issued by LINUM AB, that is, a receipt or order confirmation clearly showing the date of purchase and what you as a Customer paid for the item. LINUM AB does not handle complaints for products purchased from a reseller, as those items are not covered by this specific Agreement.

In the event of an approved complaint, LINUM AB covers all costs including shipping. A product that does not fulfil the Agreement you have entered into with LINUM AB, or that otherwise shows defects, will be considered defective and grounds for complaint. Defects in a product caused by negligent or improper handling by the Customer, daily wear and tear or similar are not classified as original defects and are therefore not valid grounds for complaint. If you as a Customer complain about a defective product two (2) years or later from your delivery date, it is your responsibility to prove that the product had an original defect. LINUM AB therefore recommends that you inspect the product(s) when delivered and report any defects as soon as they are discovered.

When you complain about a defective product, you as a Customer have the right to have the defect corrected or receive a product free from defects, provided that LINUM AB still holds the product in its assortment. In some cases, you have the right to terminate the Agreement and cancel the purchase with full refund rights. When a complaint has been accepted, you will not be held liable for any costs that have arisen due to the complaint, such as the shipping cost for returning the Customer’s order to LINUM AB. Please note that you as a Customer are obliged to minimise possible handling costs if a product proves to be defective.

9.3 Complaints regarding defects arising during transport.
All products are checked and carefully packed in durable packaging by LINUM AB’s warehouse. If you as a Customer receive a damaged package, take a clear picture of the damage and contact LINUM AB immediately. Transport damage must be reported within five (5) business days after receipt of the package. Damage reported later will not be accepted. Damage is reported to: customerservice@linumdesign.com

9.4 ARN or EU ODR.
LINUM AB follows the recommendations of the Swedish National Board for Consumer Disputes (ARN) and the European Commission Online Dispute Resolution (EU ODR).

10. Data handling policy
All data, such as personal data or other information provided by the Customer to LINUM AB as part of a document, will be stored and processed in digital form. LINUM AB is responsible for the storage and handling of the information in accordance with the Swedish Personal Data Act and the General Data Protection Regulation (GDPR). The information will be used by LINUM AB to make it possible to fulfil and ensure that the Agreement is performed. When the Customer places an order on www.linumdesign.com, the Customer accepts LINUM AB’s data handling policy. Please note that you as a Customer may always request that your data be deleted and that LINUM AB only stores data for as long as required for accounting purposes.

10.1 Personal data that is stored.
Name, address, email address, telephone number, personal identity number and purchase history with LINUM AB.

The information may be shared with third parties and used for the purposes stated below:
– A payment services partner for the purpose of ensuring that the Agreement is fulfilled.
– A logistics (transport) partner for the purpose of ensuring that the Agreement is fulfilled.

10.2 Data register.
If you as a Customer have entered into this Agreement as a private individual, you have the right once (1) per year and without charge to request access to your register. The register consists of the information that LINUM AB has collected from you. You request your information by sending a signed request to the address stated above. If the information is incorrect, incomplete or misleading, we will correct it.

10.3 Deletion of customer data.
You as a Customer may, by means of a written and signed request, have your customer data deleted from LINUM AB, with the reservation that the data necessary for LINUM AB to maintain proper accounting will be retained.

10.4 Your rights and choices.
You have rights relating to your personal data and you control your data and decide what shall be stored. The company will, on its own initiative or at the Customer’s request, correct data found to be incorrect. You may also at any time request that your data be deleted or restrict its use by contacting us at customerservice@linumdesign.com. If you believe that we do not respect your rights, contact us or the Swedish Data Inspection Authority (datainspektionen@datainspektionen.se).

As a Customer, you may at any time opt out of receiving marketing communications from us by clicking “unsubscribe” in the emails and SMS messages that we send to you. As a Customer, you are always welcome to contact our customer service for help with unsubscribing from communications from us.

You as a Customer have the right to object to our processing of your personal data. If you object to the processing, LINUM AB may continue processing the data only if it can be shown that there are compelling legitimate grounds for the processing that outweigh your interests, rights and freedoms, or if the processing is carried out for the establishment, exercise or defence of legal claims.

You as a Customer have the right to data portability, which means that you have the right to receive the personal data that LINUM AB provides in a structured, commonly used and machine-readable format and you have the right to transfer this data to another data controller.

11. Cookies
Cookies are small text files that websites place in the browser that you as a Customer use to display a chosen website. On www.linumdesign.com, you can expect different types of cookies. We use cookies to create a better user experience in the webshop, in order to improve our customers’ shopping experience as well as for statistical and marketing purposes.

Our cookies store information about your usage and the pages you have visited. This may include technical information about the Customer’s device and internet connection, such as operating system, browser version, IP address, cookies and unique identifiers. When you as a Customer visit our webshop where our services are provided, different technologies may be used to recognise visitors in order to learn more about our users. This may be done directly or through the use of third-party technology.

12. Fulfilment of the agreement
LINUM AB will begin fulfilment of the Agreement when you as a Customer receive your order confirmation by email. When you as a Customer receive your order, LINUM AB has fulfilled its part of the Agreement. When you as a Customer have provided payment and received the Products you have ordered in accordance with the agreement, the content of the Agreement has been completed.

13. Reservations

LINUM AB has the right to terminate the Agreement if the Customer has purchased a Product that for obvious reasons should not have been sold or where a clear error has occurred, such as incorrect prices or quantities. If the Agreement is terminated for this reason, the Customer has no right to compensation or any other reimbursement from LINUM AB.

LINUM AB reserves the right, without prior notice, to change the content of www.linumdesign.com, including but not limited to assortment, prices and campaigns. The changes do not affect Agreements already concluded between LINUM AB and the Customer.

LINUM AB shall not be considered liable for obligations under this Agreement if liability has arisen due to events outside the Agreement, LINUM AB’s business or as otherwise prescribed by law.

14. Disclaimers

14.1 Force Majeure.
In the event of government action or new legislation, labour conflict, war or threat of war, major disturbances of public order, sabotage, extreme weather conditions, fire, explosion, natural disaster, accident or other circumstances beyond LINUM AB’s control and which LINUM AB could not reasonably have overcome or foreseen, LINUM AB shall not be responsible for its obligations under this Agreement. In such cases, LINUM AB is not liable for damages suffered by the Customer.

14.2 External links.
LINUM AB is not responsible for any damage or problems with the Customer’s software or hardware arising when a Customer uses external links published on www.linumdesign.com

14.3 Disclaimer regarding price fluctuations or other trade barriers.
In the case of price fluctuations or other trade barriers, such as the lack of a necessary component for which LINUM AB cannot reasonably be held responsible under this Agreement, LINUM AB has the right to terminate the Agreement. In such a case, the Customer is not entitled to financial compensation or any other compensation from LINUM AB.

14.4 Disclaimer regarding changes in taxes and fees.
In the event of material changes in taxes or fees that are of major importance to this Agreement, LINUM AB has the right to terminate the Agreement. In such cases, the Customer is not entitled to financial compensation or any other compensation from LINUM AB.

14.5 Disclaimer regarding delayed delivery beyond LINUM AB’s control.
If a delivery is delayed due to an event beyond LINUM AB’s control, LINUM AB shall not be considered liable for any damage arising from the delayed delivery. In such a case, the Customer is not entitled to financial compensation or any other compensation from LINUM AB unless otherwise agreed between the Customer and LINUM AB or required by other applicable legal provisions.

15.1 Fraud.
LINUM AB will report all fraud and/or attempted fraud to the police.

15.2 Deviations between different publications.
If there are any deviations between different publications, the information published most recently shall prevail. Please note that this will not apply if the information is clearly incorrect or misleading in comparison with other publications.

15.3 Intellectual property rights, logos, trademark.
All material published on linumdesign.com, including software, logos, audio files, trademarks, text and images, is protected intellectual property. This protection means that the material may not be used without the consent of the rights holder, and that the material may not be copied or otherwise transferred to a third party without the express consent of LINUM AB.

Action will be taken against all infringements.

15.4 Purpose of the information.
All information on linumdesign.com, regardless of format, has been published solely for informational purposes so that the visitor may use the webshop. LINUM AB is not responsible for any impact or damage that may arise if the information is used for any purpose other than the above.
